A retrospective audit imposed by the Department of Transport

A retrospective audit imposed by the Department of Transport and enforced by the Irish Aviation Authority led to the sacking of an employee by United Parcel Service (UPS) who could not provide documentary evidence of short period of his previous employment.

He was unable to secure proof of his employment as a roofer for the period between 2007 and 2008 because he had been paid in cash and because one of his employers had emigrated. He was employed on part-time basis and was paid €12,000 per annum.

The employee argued that sworn affidavits demonstrated a much laxer approach to background checks and that he had been denied the opportunity to sign one in place of providing documentation.

The Employment Appeals Tribunal retired to consider the claimant’s request for 2 years salary. Reinstatement is not being sought.
